The Different Types of Larceny Charges and Penalties

New York Penal Law Section 155.05 states that larceny is committed when a person steals the property of another with the intent to deprive the owner, or another third party, of such property. It includes the wrongful taking, obtaining or withholding of another's property secured by trespassing, trickery, embezzlement or under false pretenses. Finding lost property and making no genuine attempt to find the owner of said property can also be classified as larceny. Even the act of issuing a bad check can be considered larceny.

Larceny can be either a misdemeanor or a felony, and therefore, is always a crime. Individuals convicted of petit larceny face up to one year in county jail. Grand larceny is the theft of property valued at more than $1000, and is a felony. In certain cases the theft of other items, such as firearms, credit cards, or automobiles, may also be considered grand larceny. Any instance of grand larceny is considered a felony offense in the state of New York and the accused could be facing anywhere between 4 and 25 years in prison.

Petit Larceny is a larceny where the property is valued at less than, or equal to, $1,000 . This includes property that has no monetary value. Such offense is a misdemeanor, and therefore, a crime.
