New York Penal Law Section 155.05 states that larceny is committed when a person steals the property of another with the intent to deprive the owner, or another third party, of such property. It includes the wrongful taking, obtaining or withholding of another's property secured by trespassing, trickery, embezzlement or under false pretenses. Any instance of grand larceny is considered a felony offense in the state of New York and the accused could be facing anywhere between 4 and 25 years in prison.

Petit Larceny is a larceny where the property is valued at less than, or equal to, $1,000 . This includes property that has no monetary value. Such offense is a misdemeanor, and therefore, a crime.
