Under the New York Penal Law there are various different classifications of assault ; first degree, second degree and third degree. Depending on the type of assault committed and the severity of injury or damage caused, the penalties and sentences handed down for individuals convicted of assault will vary. If a deadly weapon or dangerous instrument is used during the assault, additional weapons charges may be filed, and the level of assault offense may be higher.
Assault in the third degree is when an individual intentionally or recklessly causes physical injury to another person. Physical injuries caused by criminal negligence or recklessness with a deadly weapon are also classified as third degree assault. This level of assault is considered a Class A misdemeanor offense in the state of New York and if convicted you would be facing up to 12 months in jail.

Assault in the first degree is when an individual causes serious injury to another through the use of a deadly weapon, or the intentional disfigurement of another, or serious injury to another caused by reckless conduct depicting an extreme disregard for the lives of others, or serious injury to another caused during the attempt of or flight from a felony offense. Assault in the first degree is considered a Class B felony and if convicted you would be facing up to 25 years in state prison.
