The Town of Clarkstown Justice Court came into existence in 1786 and is considered one of the largest for criminal cases handled in the state of New York. For criminal cases, the court handles misdemeanor offenses, vehicle and traffic offenses, and Town Code and criminal offenses that apply to other areas of the law. It can also conduct preliminary hearings and arraignments and sets bail for felony cases.
Other areas the Town of Clarkstown Justice Court handles include civil, small claims and landlord-tenant cases, which entail landlords suing to evict tenants. Small claims actions cannot exceed $3,000 and they must involve a person who lives, works or owns a business in the town.
